Non-Discrimination Policy.
1. Policy Statement. Milford Borough is committed to ensuring that no person is excluded from participation in, denied the benefits of, or subjected to discrimination under any program, service, or activity administered by the Borough on the basis of race, color, national origin, sex, age, or disability, as provided by Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, the Age Discrimination Act of 1975, the Americans with Disabilities Act of 1990, and other applicable federal and state civil rights laws. This policy applies to all Borough programs, services, activities, and employment practices.
2. Non-Discrimination in Employment and Activities. Milford Borough prohibits discrimination in:
a. All employment practices, including recruitment, hiring, promotion, compensation, training, and termination
b. All programs, services, and activities provided by the Borough
c. Access to Borough facilities and public meetings
d. Contracting and procurement processes
e. Distribution of federal financial assistance
3. Accessibility Services.
a. Hearing Accessibility. Milford Borough provides the following services to ensure accessibility for persons with hearing impairments:
i. All hybrid public meetings are equipped with closed captioning technology via Zoom
ii. Written materials can be provided in advance of meetings upon request
b. Limited English Proficiency Services. The Borough recognizes the importance of providing meaningful access to services for persons with limited English proficiency.
i. Please contact the Borough Secretary for translation services.
c. Vital documents will be translated into languages commonly spoken in the community upon request utilizing AI technology
4. Civil Rights Coordinator. The Borough Secretary is designated as the Civil Rights Coordinator, and the Council Vice-President will be the alternate when the Council President has a conflict of interest or is the subject of a complaint. The Civil Rights Coordinator is responsible for:
a. Coordinating compliance with all applicable civil rights laws and regulations
b. Receiving and investigating complaints alleging discrimination
c. Ensuring staff training on non-discrimination policies
d. Maintaining records of compliance activities
e. Serving as liaison with federal and state civil rights agencies

6. EPA Compliance Coordinator. In accordance with 40 C.F.R. Parts 5 and 7, the Borough designates the Borough Secretary as the employee responsible for coordinating compliance with Environmental Protection Agency non-discrimination regulations. This includes:
a. Ensuring compliance with EPA's non-discrimination requirements for federally funded programs
b. Implementing procedures to prevent discrimination in EPA-funded activities
c. Maintaining documentation of compliance efforts
d. Reporting to EPA as required

8. Grievance Procedure. Milford Borough has established the following grievance procedure to ensure prompt and fair resolution of complaints alleging violations of 40 C.F.R. Parts 5 and 7, as well as other applicable civil rights laws:
a. Filing a Complaint.
i. Who May File: Any person who believes they have been discriminated against may file a complaint
ii. Time Limit: Complaints must be filed within 180 days of the alleged discriminatory act
iii. How to File: Complaints may be filed:
1. In writing to the Civil Rights Coordinator
2. By telephone to the Civil Rights Coordinator
3. In person at the Borough office
4. By email to the Civil Rights Coordinator
b. Complaint Requirements. Written complaints should include:
i. Name and contact information of the complainant
ii. Description of the alleged discriminatory act
iii. Date(s) of the alleged discrimination
iv. Names of witnesses, if any
v. Desired resolution
c. Investigation Process.
i. Acknowledgment. The Civil Rights Coordinator will acknowledge receipt of the complaint within 10 business days
ii. Investigation. A thorough investigation will be conducted within 90 business days of receipt
iii. Documentation. All complaints and investigations will be documented and maintained
iv. Resolution. The Civil Rights Coordinator will issue a written determination within 60 business days of receipt
d. Appeal Process. If the complainant is not satisfied with the resolution:
i. An appeal may be filed with the Borough Council within 30 days of the determination
ii. The Borough Council will review the matter and issue a final determination within 30 days
iii. The complainant retains the right to file complaints with appropriate federal agencies
e. Alternative Filing Options. Complainants may also file complaints directly with:
i. U.S. Environmental Protection Agency (for EPA-funded programs)
ii. U.S. Department of Justice
iii. Pennsylvania Human Relations Commission
iv. Other applicable federal or state agencies
9. Training and Education. The Borough will provide regular training to all employees on:
a. Non-discrimination policies and procedures
b. Accessibility requirements
c. Cultural competency
d, Proper use of translation services and assistive technologies
10. Policy Distribution and Notice. This policy will be:
a. Posted prominently in all Borough facilities
b. Published on the Borough website
c. Included in employee handbooks
d. Made available in alternative formats upon request
e. Distributed to contractors and subcontractors receiving federal funds
